1: Payment Methods & Terms

1.1 Credit/Debit cards
Customers can pay for their goods using their Credit/Debit card by completing a transaction on our website using our integrated and secure merchant portal.

1.2 BACS:
Customers can pay for their goods via BACS by completing a transaction on our website and then transferring funds directly to our account using their personal online banking service.

1.3 Removing items from sale on www.jonesantiquelighting.com
Payment must be received in full before any goods are designated “SOLD” and/or removed from our web-site.

1.4 Deposits
Jones Antique Lighting will not accept any form of holding deposit. All our lights are available on a first come first served basis.

1.5 Cancellation of Sale
Jones Antique Lighting retains the right to cancel any transaction to any customer at any time up until the point of dispatch.

1.6 Release of goods
Under no circumstances will goods be dispatched for delivery until payment has been received in full.

2: Refunds & Returns For “On-Line” Transactions

2.1 Purchases made On-line via www.jonesantiquelighting.com are covered by the Consumer Contracts Regulations (CCIACR) which give all customers a statutory right to a “cooling-off” period. This entitles any consumer the right to cancel any purchase and receive a full refund, regardless of whether the goods are faulty up to 14 days from the day they receive their goods.

2.2 Customers wishing to cancel their contract under the CCIACR must notify Jones Antique lighting in writing via the CONTACT US page or directly via email to jonesantiquelighting@gmail.com

2.3 It is a condition of sale that a customer, who has notified Jones Antique Lighting that they wish to cancel a contract under CCIACR, must return all goods to Jones Antique Lighting within 14 days of that date and pay for any delivery costs incurred. If you fail to comply with this obligation we may have a right of action against you for compensation.

2.4 Refunds will be issued to customers within 14 working days from when goods are returned to Jones Antique Lighting or when the consumer provides evidence of the goods having been returned to Jones Antique lighting.

2.5 Please take care of the goods: If goods are returned damaged, incomplete or different from their original sold condition Jones Antique Lighting has the right to deduct an amount from the refund to reflect any loss in value of the goods supplied, if the loss is the result of unnecessary handling of the goods by you.

3: Refunds & Returns for “In Store” Transactions

Jones Antique Lighting will refund or exchange any purchase in full provided that it is returned within 14 days of purchase to Jones Antique Lighting in its original sold condition. Yours statutory rights are not affected.

4:  Antique/2nd Hand Goods & “Defected” 0r “Dissimilar” items

4.1 The customer understands that all our lights are second-hand goods, they are fragile in nature and have significant age. They understand that the goods they are purchasing will not necessarily be in perfect condition, may have defects and/or not be exactly similar.

4.2 Jones Antique lighting will always try to describe a  “defected” or “dissimilar” light in its description. When this is deemed to be significant enough to affect the items overall integrity and value we will mark the light As Found and sometimes include photographic evidence.

Defects may include:
Cracks, chips, paint marks, scratches, burns, colour imperfections, water marks & stains to glass, marble or alabaster.
Dents, bends, scratches, missing parts, burns & patination variations to metalwork.
Glued, soldered, welded or moulded restorations to glass, marble, alabaster or metalwork.

Differences may include:
Colour, size, pattern or shape of glass
Size, shape, patination or design of metalwork

4.3 The Customer understands that when they place a purchase for an item marked As Found or described as defected or dissimilar that they are accepting of it and cannot therefore return the item for a statutory refund in relation to that particular fault. Your rights to a refund under the CCIACR are not affected.

5: Delivery of Goods

The Consumer Rights Act states that all deliveries must be made within 30 days of purchase unless a longer period has been agreed. If your goods are delivered outside this period then you are entitled to terminate your contract and receive a full refund.

5.2 Customers wishing to cancel their contract under the CCIACR must notify Jones Antique lighting in writing via the CONTACT US page or directly via email to jonesantiquelighting@gmail.com

5.3 Jones Antique Lighting can make no guarantee to deliver goods by or on a certain date or time and cannot be held liable if goods arrive later or earlier than the delivery date or time stipulated by Jones Antique lighting or the 3rd party Courier Company.

5.4 The Consumer Rights Act states that the retailer is responsible for the condition of goods until they are received by the customer or by your agent.
Customers using Jones Antique Lighting’s postage and packaging service will have the right to a repair/restoration, partial refund settlement (clause 10) or full refund (clause 11) in the event that their goods, fail to arrive (clause 8) or arrive damaged/faulty (clause 9)

6: Postage & Packaging Service

6.1 No prices advertised on the website of Jones Antique Lighting include the cost of any postage or packaging service.

6.2 Jones Antique Lighting reserve the right to not offer a postage and packaging service, to any customer, at any time.

6.3 Free delivery Service within the UK

Jones Antique lighting offer a free postage and packaging service for all order over £195 within the United Kingdom excluding The Scottish Highlands, Islands and Northern Ireland. It is a condition that Jones Antique Lighting will decide which courier company and service is provided.

6.4: Charged delivery Service

Orders falling under £195 within the Uk and all orders within the The Scottish Highlands & Islands, Northern Ireland, Europe and the Rest of the world are not included in our free postage and packaging service and are liable for our charged delivery service. It is a condition that Jones Antique Lighting will decide which courier company and service is provided.

6.5:  Import Duty, V.A.T/Import tax, Courier Customs/Handling Fess (Customers outside U.K & Northern ireland)

6.5.1: Import Duty

Our lights fall into 2 catagories (as set out below) in relation to international exports codes and import duty.

Export code 970600. Antique Exceeding 100 years  For most countries this means an import duty rate of 0%.

Export code 940510, Chandeliers and other electric ceiling or wall lighting fittings: For most countries this will mean a variable import  duty rate. *E.U countries and those other countries with a free trade agreement with the U.K  please note this charge will be at 0%*

6.5.2: V.A.T/Import Tax

All E.U customers and some other international clients will be charged V.A.T/import tax (at their % national rate) based on the combined value of your purchases,  shipping fees and import duty(if any).

6.5.3: Courier Customs/Handling Fees

The Courier Company will charge a customs clearance administration charge for dealing with your import and clearing customs.

6.5.4: It is incumbent upon the customer to be aware of all such potential import charges as outlined above and to make enquires with their local chamber of commerce.  Jones Antique Lighting and any third-party courier company will not under any circumstances be held liable for such charges.

6.6 If a courier company is unsuccessful in delivering goods to a customer because the customer is not available to receive their goods or the customer supplies Jones Antique Lighting with inaccurate delivery details and the goods are returned to Jones Antique Lighting then the customer agrees that Jones Antique Lighting may recharge the customer for any re-delivery costs incurred, which may be up to the value of the initial delivery costs.

7 Collecting Goods “In Store”

7.1 Customers who do not want to use Jones Antique Lighting’s postage and packaging service can arrange the collection of their goods in store. The customer agrees that they have received and accepted their goods whether they themselves or their agent (a friend, family member, associate, personal chauffeur, courier, shipper, etc) acting on their behalf collects the goods directly from Jones Antique Lighting.

7.2 At the point where goods purchases in an “off premises” trasaction are collected in person, the transaction will become an “in store” transaction and will not be governed under the (CCIACR) as set out in clause 2. Your statutory rights are not affected.

7.3 The customer agrees that due to the fragile nature of our goods and their high value that a reasonable time to inspect goods for any fault/damage and report this to Jones Antique lighting will be no later than the point of collection. Customers will not be able to return items for a statutory refund at a later date in relation to any fault/damage that was unreported at the point of collection.

8: Reporting undelivered Goods in Transit

8.1. For UK deliveries, if your lights have not arrived within 5 working days of dispatch then customers are asked to report this to Jones Antique Lighting but not before. Jones Antique Lighting will liaise directly with any third party courier in an attempt to recover an undelivered consignment and keep you the customer updated. Your rights to a refund as set out in Clause 2 and/or Clause 5 are not affected.

8.2 For International deliveries, if your lights have not arrived within 5 working days of the estimated courier delivery date then customers are asked to report this to Jones Antique Lighting. Jones Antique Lighting will liaise directly with any third party courier in an attempt to recover an undelivered consignment and keep you the customer updated. Your rights to a refund as set out in Clause 2 and/or clause 5 are not affected.

9 Reporting “Damaged” and “Faulty” Goods In Transit

9.1 The customer agrees that due to the fragile nature and high value of our goods, that a reasonable time to inspect for any fault/damage and report this to Jones Antique Lighting in the form of written notification via email to jonesantiquelighting@gmail.com will be the next working day after the delivery date. Customers who report faults/damage to goods after this date will not be able to return goods for a statutory refund in relation to this fault/damage.

9.2 The customer agrees that a reasonable time to inspect for any faulty electrical goods and report this to Jones Antique lighting will be 40 working days after the purchase date. Customers who report faulty electrical goods to Jones Antique Lighting after this date will not be able to return goods for a statutory refund in relation to this fault.

9.3 The customer agrees that a reasonable time to inspect goods and report to Jones Antique lighting with regards to any other statutory reason not covered in clause 9.1 & 9.2 will be 6 months after purchase. Customers who report to Jones Antique lighting after this date will not be able to return goods for any statutory reason.

10: Repair of “Damaged/Faulty” Goods & Partial Refund Settlements

10.1 If Jones Antique lighting deems it possible for a light to be repaired/restored then we will offer to have the light repaired/restored for you completely at our expense. Your statutory right to a full refund is not affected.

10.2 The customer agrees that a reasonable amount of time for repairs/restorations should be 30 working days from the day after the “damaged” or “faulty” goods are received by Jones Antique Lighting.

10.3 Under no circumstances must Restoration/Repair work be carried out on any “damaged” or “faulty” goods by the customer or his agent. Jones Antique lighting will not offer any refund or compensation on restored/repaired “faulty” goods which has been undertaken by the customer or their agent.

10.4 Any delivery expenses that a customer incurs as part of the restoration/repair process will be settled within 14 days after the day Jones Antique Lighting receives written and/or photographic evidence of the expense by the customer.

10.5 If Jones Antique lighting are unable to fully restore/repair a light back to its original sold condition then a partial refund settlement will be offered as compensation. Your statutory rights to a full refund are not affected.

10.6 If Jones Antique Lighting deems that goods cannot be repaired/restored a customer will be offered a partial refund settlement if applicable. Where there has been a total loss then the partial refund settlement offered will be the purchase price.

10.7 Refund settlements will be paid within 14 days after the day the settlement is accepted.

11: Returns & Refund of Damaged/Faulty Goods

12.1 If a customer does not wish to accept a repair/restoration or a partial refund settlement on any faulty/damaged goods then a consumer has a statutory right to request a full refund. In this instance Jones Antique Lighting may request that the goods be returned to us. Customers failing to return goods to Jones Antique lighting when requested to will be in breach of contract and Jones Antique lighting will be able to charge for the direct cost of recovery of those goods.

11.2 Customers requesting a full refund must notify Jones Antique lighting in writing via the CONTACT US page or directly via email to jonesantiquelighting@gmail.com

11.3 Jones Antique Lighting has the right to make deductions (from any refund) if faulty/damaged goods are returned with further damage, are more incomplete or are different from the reported faulty/damaged condition and this is caused as a direct result of the customer breaching their statutory duty to take reasonable care of the goods.

11.4 Refunds will be issued to customers within 14 working days from when goods are returned to Jones Antique Lighting or when the consumer provides evidence of the goods having been returned to Jones Antique lighting.

11.5 Any delivery expenses that a customer incurs returning damaged/faulty goods to Jones Antique lighting will be settled within 14 days that Jones Antique Lighting receives written and/or photographic evidence of the expense by the customer.
